As a representational democracy there are several distinct constitutional provisions that cut against the first three words of our foundational legal document, “We The People.” Dean Latonia Haney Keith and Professor McKay Cunningham of Concordia University School of Law will identifiy the anti-democratic provisions within the U.S. Constitution, including the Electoral College, the U.S. Senate, and the federal judiciary, including the Supreme Court. These legal scholars will analyze the policy arguments that support and that undermine these anti-democratic institutions, before exploring some of the proposed changes to them.
