Investigations are an essential task at every stage of litigation – determining whether facts exist to bring a claim and, once a complaint is filed, building a case for trial. When conducted by attorneys, or investigators working as their agents, this fact-finding function is subject to a range of ethics restrictions. Where those restrictions are arguably violated, attorneys not only potentially expose themselves to ethics complaint but also risk compromising the underlying litigation. This program will provide you with a real world guide to the ethics issues of conducting pre-litigation investigations, including internal company investigations, external investigations, and investigating members of a jury pool or jury.
