Like email before it, texting has become mainstream. Clients often ask for and get the mobile numbers of their attorneys and attorneys want to communicate with their clients in that way. Clients often think that it is private and a way to get an immediate response from their attorneys. But there are several ethical issues in texting with clients, including confidentiality, the ability to competently advise a client in short messages, the potential loss of the attorney-client privilege, and more. This program will discuss ethical issues in the new world of attorneys and clients texting each other.
