Virtually every communication a lawyer makes on behalf of a client is a negotiation. This is equally true of communications in litigation with opposing counsel as it is in a transactional negotiation. There's an indistinct line between ethical propriety and going too far - between permissible "puffing" or "boasting" and outright (thus unethical) deceit. This program will discuss the many shadings of gray when attorneys engage in negotiations.
